The Impact of the Constitution on the Development of the legislative institution in Jordan

Abstract

This study discusses the constitutional provisions and guarantees that assure continuity and immunity of the Jordanian House of Representatives through analyzing the perspective of the Executive Branch's constitutional right to dissolve the Parliament and this is the political dimension of the study. The assumption is that the existence of the right of dissolving the parliament might affect the presence and development of Parliament itself, impeding it from performing its political role properly. The researchers noted that at least from a theoretical point of view the Jordanian constitution provided guarantees and assurances that preserve continuity of the parliament for longest periods and contributes to protecting it from misuse of power by the Executive Branch. The researchers suggest that dissolving the Parliament should be monitored and reviewed by the high court of justice. The research adopted the descriptive analytical approach of scientific inquiry in addition to legal analysis.
